Acceptance of the order by the customer implies, in any case, that the buyer accepts and adheres to the following general conditions of sale and supply.

PRICES

All prices included in this web site do not include V.A.T., nor the corresponding costs of the Community Directive on environmental costs derived from Directive 2002/96/EC of the European Parliament, modified in its Article 6 by Directive 2012/19/EU, transposed to the Spanish Legislation with the R.D. 110/2015 (WEEE), which establishes the following application of the recycling cost depending on its weight:

0,20€/unit (less than 600gr.).
0.40 €/unit (from 750 gr. up to 5 kg)
0,60€/unit (more than 5kg)

The prices are fixed as long as the order is picked up at Hydrofarm Europe warehouse and do not include transport costs.
The final prices shown in this price list may be modified by Hydrofarm Europe according to the increase in the supply and factory costs incurred in selling its products.

TRANSPORT

Hydrofarm Europe is not responsible for breakages, breakdowns, thefts and losses that may occur during the transport of the material and Hydrofarm Europe is not responsible for the time elapsed in the shipment.
Any problem related to transport must be notified to Hydrofarm Europe within 24 hours after receipt of the order. In addition, any defect or damage to the goods must be noted on the delivery note.
In case of damage to the goods or delay in the reception of the order, you should communicate it to the following e-mail addresses:

In the case of damage to the goods, the corresponding images showing the state of the package must be attached to the e-mail.
After 24h from the delivery of the goods, Hydrofarm Europe is not responsible for any damage caused during transport.
Carriage paid on orders over 1000 ¤ (in peninsula, in other cases please consult with Hydrofarm Europe).
Unless otherwise agreed, Hydrofarm Europe reserves the right to make partial shipments and, consequently, partial invoicing on account of the total. 

DELIVERY TIME

The delivery time shall be understood to be approximate and shall start to run from the moment of receipt of the acceptance of the order by Hydrofarm Europe.
Delays in the delivery of the order due to force majeure or other causes beyond Hydrofarm Europe’s control shall not entitle the purchaser to any compensation whatsoever.

CLAIMS

After eight calendar days from receipt of the goods, Hydrofarm Europe will not accept claims related to the goods shipped. 

MATERIAL RETURNS

Hydrofarm Europe will only accept returns for defective material. In any case, material returns must necessarily be notified and approved by Hydrofarm Europe. In case of return, the following addresses must be notified and the cost of return transport will be borne by the buyer

If the package arrives at our premises without prior notification, it will be returned to the sender.
Once the defective goods have been returned, they will be checked by the technical service and the damage will be assessed. If the damaged material is a manufacturing defect, it will be immediately replaced under warranty. If the material has been improperly handled by the customer, it will not be covered under warranty.
In case of defective material under warranty, Hydrofarm Europe will replace the goods and resend them to the customer at its own expense.
The following materials will not be credited and, consequently, will not be authorized for return:
(c) Specially manufactured materials.
d) Special imports and made exclusively for specific orders of a customer.

TERMS OF PAYMENT

 Payments shall be made by bank transfer, payment in advance and prior shipment of the goods, except in   cases where otherwise agreed.

MODIFICATIONS TO THE TERMS AND CONDITIONS OF SALE

Hydrofarm Europe reserves the right to modify these conditions of sale.

SAMPLES

Samples will not be invoiced to the applicant, unless otherwise agreed between Hydrofarm Europe and the customer, and must be delivered within the stipulated deadlines.

SUMMISSION

For any questions that may arise in the performance and interpretation of the operations and contracts entered into between Hydrofarm Europe and its customers, the latter expressly waive any forum that may correspond to them and expressly submit to the jurisdiction of the Courts and Tribunals of Zaragoza.

APPLICABLE LAW

This contract is of a commercial nature and shall be governed by its own clauses and within the provisions of the Commercial Code and the General Contract Conditions Law
